These terms and conditions are the terms which apply when you access the website http:/www.elementsbeautyuk.com and/or http:/www.matisskincare-elements.com. By accessing these websites or when you place orders to purchase any of the products on the website you agree to be bound by these terms. We reserve the right to modify or change these terms at any time and we will endeavour to highlight changes on the website, however it is your responsibility to check for changes in terms and conditions.
ORDERING FROM THE WEBSITE.
All orders are subject to availability and to acceptance by us (Elements Beauty Ltd). Your order via our online purchase order form constitutes an offer to us to buy the products from the website. All communication will be addressed to the email address you supply when you order. We will send an email to confirm that we have received your order, an email will also be sent when we send out your order which will be done on clearance of payment by you. Before placing an order you can view and amend your order details at anytime by clicking on ‘cart’.
DELIVERY CHARGES
We only deliver to the UK using Royal Mail 2nd class recorded delivery, and should normally take 3-5 working days.
A signature will be required on delivery of your order, if nobody is available to sign for delivery you may have to collect your parcel from your local Royal mail depot or post office.
Unless otherwise stated delivery will be made to the address provided by you. On arrival of your order you must only sign for it if it arrives in good condition, if the parcel is damaged please do not accept it, we will only refund goods returned by you if they are returned in the original condition and packaging. As soon as the product is delivered to you, you are responsible for it.
Royal Mail will not deem a parcel to be lost until it has been in the postal system for a period of 14 days. Although it is unlikely deliveries will take this amount of time we are unable to dispatch a replacement or issue a refund until this period of time has elapsed.
PAYMENT
We only accept payment by PayPal and your order will be dispatched on clearance of your payment. The price of products will be stated on the website at the time you place your order, this includes UK Value Added Tax and delivery charge.
If we discover an error in the price of the product you have ordered we will not be liable to supply that item at the stated price, provided that we notify you before we dispatch the item to you. In these circumstances we will inform you of the correct price as soon as possible and give you the option of reconfirming your order at the correct price or cancelling. If you cancel no payment will be taken or a full refund will apply.
RETURNS AND REFUNDS
Any product supplied by us will be of satisfactory quality, fit for intended purpose, and will conform to the description given on the website.
You have the right to cancel your order within 14 working days from the day after you receive your order and receive a full refund even if the product is not defective.
We hope that you will be happy with your purchase from us, if not you are entitled to a full refund provided you notify us in writing within 14 working days starting the day after you receive your product, this can be by letter or email. In order to receive a refund you must have taken care of the product, must be in its original packaging and not been used or damaged.
You will be responsible for the cost of returning the product to us, unless it is faulty or incorrect. Please return the product in suitable packaging to ensure it reaches us in good condition.
We will refund the purchase price of any goods returned no later than 14 working days after receipt of the returned item. Please note that if you fail to take reasonable care of returned products, or fail to return the product to us, we will be entitled to make a claim against you for any loss we suffer.
LEGAL AND LIABILITY
You have certain rights under the law. These include that any products supplied by us will be of satisfactory quality and fit for their intended purpose.
Nothing in these terms is intended to affect your statutory rights.
If we do not comply with these terms we shall only be liable for losses which are a reasonable foreseeable consequence of such a breach, up to the maximum purchase price of your order. Losses are foreseeable where they could be contemplated by you and us at the time of entering into this agreement.
Information provided about the products is intended to be used for educational or informational purposes only. The information and products are not intended to diagnose, treat, cure or prevent any condition or disease.
We are not responsible for losses not caused by our breach, or failure to provide or access the website or where we are unable to fulfil our obligations to you caused by “events beyond our control”. These include but are not limited to fire, flood, storm, riot, civil disturbance, war, terrorist activity, industrial strike and acts of god.
If any of these terms are found to be invalid by any court or regulator, the other terms shall continue to apply.
The products we supply to you are made to the highest standard and fit for purpose. Although adverse reactions are rare, if you have an allergic reaction to a product this is deemed beyond our control. Therefore the owners of this website and it's staff cannot be held responsible in any way.
